To be subjected to a simple urine test to receive money and benefits from the U. S, government is not too much to bear. It is no different than obliging to mandatory drug testing for a job. Florida state governor Rick Scott has stated that in his state alone they will save 9 million dollars a year because of benefits being cut due to mandatory drug testing. With these kinds of cuts in spending nationwide, it is sure to reduce government spending a great deal. Not to mention the effect it will have on drug abusers. Go Vegetarian; You Have No More Excuses Essay Everyday, more and more people are making the choice to lead a vegetarian or vegan lifestyle. Vegans abstain from partaking in all animal products, including honey and dairy products. Vegans do not use goose down, silk, wool or leather. The American Vegan Society (AVS) says that vegan is describing a lifestyle that avoids all forms of animal life, not just a diet (Krizmaniac 8). The definition of a true vegetarian is a person who does not eat any meat products or gelatin, but does eat dairy products (Krizmaniac 6). People who choose to live a vegan or vegetarian lifestyle may have several reasons for making that choice, including animal rights and health reasons. One of the two most common reasons people choose to be vegan or vegetarian is due to harsh living conditions, mistreatment and slaughter of animals on industrial farms. Factory farmed animals are giving many types of hormones to reproduce more, grow larger and faster. As for cows, many people believe it does not hurt them to be milked; however it is unprofitable to keep a cow once its milk production declines. Therefore, dairy consumption leads directly to slaughter. By using these hormones, cows on industrial farms are forced to produce 8. 2 tons of milk per year, whereas a normal cow would produce 3.5 tons of milk per year, naturally (Vegan Outreach 4). As for birds on farms, they are the most overcrowded. They are kept in cages stacked one on top of the other, so that the feces falls from the top to the cage below. Since they are kept in wire cares and cannot move, it is common to find the skin of their toes frowns around the wire bottom (Vegan Outreach 4). Also, to get the hens to reproduce more often, they are starved for eighteen days and kept in the dark to shock them into another egg laying cycle, which causes about ten percent to die (Vegan Outreach 4). The average hen should produce about seventy eggs a year, but on industrial farms, the count has been up to tow-hundred and seventy-five per year (Vegan Outreach 4). And because they have been manipulated to lay such large eggs, the hens uterus is often expelled along with the egg. Pigs are also extremely crowded, living on hard floors, commonly covered with feces and vomit. Because of this confinement, pigs become aggressive and will fight and bite each other so the farmers have to cut off their tails and castrate them. However, farmers find this as an unnecessary expense and dont bother to use anesthesia. The second of the two of the most popular reasons for being vegan or vegetarian is health related reasons. Meat eating is linked to many types of cancers such as colon, breast, prostate, cervical, lung, uterus and ovarian because the heterocylic amines found in meat (Teisler 1). Plus, people who consume animal products are ten times more susceptible to cancer. In addition, men who eat meat are at a 3.6 times greater risk of prostate cancer and women who eat meat and dairy are at a 3.8 times greater risk of breast cancer (How To.. 2). I never taught that a good act may become evil, but there is a follow-up phrase, by reason of circumstances. So, a good act may become evil by reason of circumstances and by circumstances we mean, the situation in the present time. As far as I know, this is always been done by people who doesn’t have enough awareness in a particular area he or she currently stay. This good  act that may become evil could be considered as an extrinsic act where the act which is in itself is not evil but is now evil on account of something. I thoroughly searched how a good act may become an evil act and I found out that it becomes evil when you feel you do something good and you are proud of it but in the other side, you’ve just broken a law without further notice. For instance, you saw street children in the sidewalk in Manila, and then, due to your compassionate heart, you gave them coins as your alms to him and you feel great about it. It is good to your side, but it is bad for the community, because you have no assurance that the money you’ve just gave would be spent for food. You gave alms to make you feel better from the pity in your heart; your money, although given with good intentions, just might encourage children to commit crime and make their parents lazy. Children should not beg, they should be in school studying, be with their parents who would take care for them. If you truly wish to do good, you shouldn’t give alms, you should take these children to a good institution that would take care of them, to nurture them and to change their lifestyle. Most of us feel great whenever we encounter these situations, helping others, but some of us are doing this to be known and their hearts are with pride. The true essence of giving is that you never boast to what you did, hence, you give secretly and helping others anonymously. You don’t take credits to what you’ve done because it is a part of your life, to help others, not like those politicians and other government officials that whenever they do projects in helping people, they always put their large name with it stating that it was there project, for the purpose that the people would know that they are good. Slavery is an American embarrassment; in present day, African Americans and woman have gained the basic rights given to every American. (3) Slavery existed in every colony in the New World from Canada to the Rio de la Plata. (3) It emerged as a way of buying and selling humans to produce labor needed on the Plantations in the early seventeenth century. However, prior to the full system of slavery, blacks were relatively equal to whites. They were able to own land, make their own money, and live with the same rights as whites. Anthony Johnson is one slave from his era to live a successful life. He started as a slave in Virginia, but later fought to achieve the American Dream. (4) Bought into slavery Anthony seemed to have no control over his future. He was referred to as â€Å" Antonio a Negro† and was purchased to work on the Bennett plantation in the tobacco fields. (8) As every American slave, Anthony had to fight day by day to survive. The poor living conditions with no food or water took a toll on his new life in the Americas. Living each day he was exposed to death, cruelty, and starvation. He seemingly had no opportunity of starting a family because of scarcity of woman; which gave him no choice other than slavery (9). On March 22, 1622, the Indians of Tidewater Virginia attacked Edward Bennett’s tobacco plantation in Virginia (9). The attack on the plantations killed over three hundred and fifty colonists; fifty-two were killed at the plantation (9). Anthony Johnson was one of the twelve lucky survivors. He was fortunate enough to gain his freedom after the attack; all of the people fled their own way. He was able to start his quest to living the American dream, and later gained the name Anthony Johnson. Anthony Johnson got a fresh start in the new world. He was finally able to start a family, he married a woman named Mary. She was the only female to be living at the Bennett’s farm in Warresquioake. They would live together for over forty years and have four children. Bennett later became governor of Northampton. When the Johnsons moved there, Bennett looked after their legal and economic interests. (11) In 1640, Johnson and his family gained an estate (11). Their main source of income came from raising cattle and hogs, which helped with the local economy. Anthony later was able to obtain two hundred and fifty acres of land for his estates; he purchased five headright certificates to help with the land. (11) The land was located on Pungoteague Creek and later had a devastating fire. The fire burned the plantation to the ground and Anthony suffered hard times with the lack of money and resources to start the farm again. He petitioned and gained legal excuse from paying taxes for his wife and two daughters. The reduction of taxes helped Johnson rebuild his plantation. The legal aspects showed that Mary and her two daughters were equal of white women in Northampton County because of the tax system. All black women and men had to pay taxes, whereas only white men who made an income paid. White women were exempt (12). Johnson’s life was like that of the white men during this time. He was able to trade with his white neighbors and buy his own slaves to work for him. Casor, a slave under Johnson, pleaded to Robert Parker, a white man, that Johnson was holding him illegally. He took Casor to his tobacco plantation because he was supposedly a freeman. Johnson was enraged because Casor did not have the indenture he claimed to have. He and his family had a meeting and decided to set John Casor free from his plantation (14). On March 8, 1655, Johnson regained the right of slave Casor by suing Robert Parker. He not only took a white man to court, but he also defeated him, declaring Casor Johnson’s slave for life (15). Anthony was treated with respect; he had the legal documents and his actions were not questioned. Later Johnson would proceed to sell most of his farm and give the rest to his youngest son to help him start a life of his own. Anthony and his wife moved to Maryland as headrights, but they remained free for the rest of their lives. He leased three hundred acres of plantation; he later named the land â€Å"Tonies Vineyard†. (16) After Anthony’s death, Mary renegotiated the lease. She was successful and paid the colony taxes and the annual rent each time. The Johnson family was able to live the remainder of their lives as free equals to the white society. In seventeenth century Northampton, a man’s place in the chain was dependent partly on wealth and race (45). Because of this system, some blacks were able to gain freedom and prosper (68). Many Northampton documents feature names of black men and women who owned their own land. They were able to have families and provide for the welfare (68). Nineteen percent of black men even owned a home. Free blacks on the Eastern Shore significantly had both family and given names (69). These names allowed the family connections to be made. In New Netherland, many black men were free and faced very little discrimination. They were even able to indenture a white female servant for one year (71). The authors are very convincing; I do believe that it was possible for blacks and whites to live together in harmony. In the text it shows how blacks and whites shared legal rights in the seventeenth century, this helped African Americans gained rights in the mid 1900’s. It caused blacks to argue why they couldn’t have freedom when there is evidence of previous peaceful equality (20). Another reason that I believe harmony was possible between blacks and whites are that they could live together as neighbors. In the seventieth century blacks could own land and had the ability to free market. They could buy and sell goods for profit; they could even trade with the white Americans for certain resources needed to be successful. African Americans had the ability to own their own slaves just like white men. Land owning African Americans had to pay taxes just like everyone else owning land. The text shows how African Americans in the seventeenth century had the rights to living free among whites where segregation was not a factor in everyday life. The title of the book Myne Owne Ground means that if you are not allowed to go after liberty and freedom or own land, then freedom isn’t really free. It means in order to be truly equal, you must own your own land. Giving African Americans the freedom to be successful played a huge role in freedoms given today. Without the study of the equal rights given to blacks in the seventieth century, todays freedoms given to all would not have been as accepting in modern day culture.

Types:There are two basic types of weight loss surgery — restrictive surgeries and malabsorptive/restrictive surgeries. They help with weight loss in different ways. Restrictive surgeries:  work by physically restricting the size of the stomach and slowing down digestion. A normal stomach can hold about 3 pints of food. After surgery, the stomach may at first hold as little as an ounce, although later that could stretch to 2 or 3 ounces. The smaller the stomach, the less you can eat. The less you eat the more weight you lose. Malabsorptive/restrictive surgeries:  are more invasive surgeries that work by changing how you take in food.In addition to restricting the size of the stomach, these surgeries physically remove or bypass parts of your digestive tract, which makes it harder for your body to absorb calories. Free Online Research Papers There is no precise legal definition of an ‘unincorporated association’, but according to Lawton LJ in Conservative Central Office v Burrell , there must be some mutual duties and obligations between the members of the association. The general idea seems to be that an unincorporated association will comprise of a group of individuals who attach themselves as members of the association in order to achieve some particular purpose. Unlike an incorporated company, an unincorporated association possesses no legal personality, it cannot be separate and distinct from its individual members, and so cannot be afforded the same rights and liabilities entitled to an independent person . Consequently, it cannot, generally speaking, hold donated property or assets unless the donation is for it’s purposes. If the purposes of the association are charitable under the provisions in section 14 of the Charities Act 1993 (to be replaced by similar provisions in the Charities Bill 2005), then the gift can be for charitable purposes and will therefore be valid. However, the problem of property holding in unincorporated associations arises where the association is formed for non-charitable purposes, since gifts to these associations must be held on trust, but the trust will be automatically void simply because the association has no legal personality and therefore cannot be a beneficiary under the trust . The idea that a trust must have someone to compel performance of it forms the basis of the beneficiary principle established by Grant MR in Morice v Bishop of Durham . In response, the courts have tried to avoid the effect of the beneficiary principle on non-charitable unincorporated associations in a variety of ways. The initial idea that a gift be interpreted as belonging to the members of the association is virtually redundant in today’s law, since it allows members to spend the assets however they like, and not specifically for the purposes of the association – which is more than likely what the donor intended (as noted in Leahy v Attorney-General for New South Wales ). There appear now to be only two significantly identifiable possibilities in overcoming the property holding problem. Firstly, the courts could construct a gift to an association as a gift for the benefit of the members, to be held on trust (Re Denley approach) , or alternatively, as a gift to the members to be held on the basis of the contractual obligations between them contained in the rules of the association (contract-holding theory ). The ‘Re Denley’ (or trust analysis) approach is really an exception to the beneficiary principle, rather than a direct solution to its consequences on non-charitable unincorporated associations, as it validates what would otherwise be an invalid private purpose trust as in (Re Endacott ). Nonetheless, since it does not infringe the beneficiary principle it can be a workable approach if the objects of the trust are certain . One of the main benefits of this approach is that gifts on trust will no doubt mirror the settlor’s intentions, however, this construction is weakened by its limitation only to inward looking associations – existing solely to promote the members interests. On the other hand, the contract-holding approach goes a step further than the Re Denley approach, in that it is also applicable to outward looking unincorporated associations, which operate to promote some external cause or purpose. This approach was duly followed in Re Recher’s Will Trusts , where Brightman J held that a gift to a non-charitable society could be construed as a gift to benefit the members of the association, subject to their contractual obligations contained in the rules of the association. In addition, the approach ensures that the settlor’s intentions are observed, insofar as it ties a contract over how the money is to be spent by the members. Comparison would, prima facie, suggest that the contract-holding theory is more advantageous as a solution to the property holding problems in unincorporated associations, particularly as the scope of its application is that much wider than the trust analysis approach. However, the contractual analysis approach is not without its flaws either. For one, the whole idea that the members hold trust property on the basis of their contractual obligations is evidently a risky one, since the members will always be free to alter the terms of the contract at a general meeting. Worst still, if this occurred, neither the donor nor his estate could do anything since s/he will not be privy to that contract if s/he is not a member of the association. In addition, following the decision in Re Bucks, the contract-holding approach implies that only existing members of the association can have entitlement to its assets on its dissolution. The resulting effect is that a newly acquired member of the association will acquire entitlement to the assets, even though no formal transfer has ever taken place with the previous member. This seems inappropriate; since it may well be that the settlor never intended this to be the case. Further, in reality, by the very informal nature of their construction, many unincorporated associations exist without contractual agreements between the members, and in such cases the contract-holding theory cannot operate. The need for a contract is also problematic when dealing with testamentary gifts, because, to put it simply, dead people cannot possibly contract. This problematic area within the contract holding theory has not gone without notice in the past, and it was noted by Brightman J in Re Recher’s Will Trusts , who commented in his judgment that: â€Å"†¦It would astonish a layman to be told that there was a difficulty in his giving a legacy to an unincorporated non-charitable society which he had, or could have, supported without trouble during his lifetime.† Application of the contract-holding theory also has its difficulties when deciding how any surplus property or assets should be distributed if an unincorporated association dissolves under a rule in Re William Denby Sons Ltd Sick and Benevolent Fund . In such instances, the courts can choose to hold the property on a resulting trust for the donors ; or give the property to the Crown as bona vacantia . However, these two options were disfavoured in Re Bucks Constabulary Widows’ and Orphans’ Fund Friendly Society (No.2) where the court took a more pragmatic approach, recognising that surplus property could be distributed equally between members. It follows that since the decision in Re Bucks, this is now the preferred method adopted by the courts, thereby supporting the use of the contract-holding theory. In spite, of its numerous imperfections, the courts still tend to favour contractual analysis over trust analysis when dealing with property holding, since cases such as Leahy(above), and Neville Estates(above) insinuate that Re Denley approach rarely works. Whatever the case, even where the contract-holding theory or the Re Denley trust construction can be used as a solution to the property-holding problem, they may still fall victim to the unforgotten ‘rule against perpetuities’ – which will make a potentially valid trust for property in an unincorporated association void if it can potentially last for more than 21 years after the death of the death of the specified objects in the trust . In conclusion, considering the array of problems within the contract-holding theory, it would not, in my opinion, be unfair to assert that it is in need of heavy reform, but in the interim I would agree that in light of the various other methods of construction of a ‘gift’ that the courts have adopted in the past, the contract-holding theory remains the best, and most workable, approach so far. There has been suggested by writers Hayton and Mitchell , that non-charitable purpose trusts held in unincorporated association should have an enforcer who will be able to take charge of the trust. This would undoubtedly solve the problem the contract-holding theory has in satisfying the beneficiary principle with regard to non-contractual members, thereby extending the scope of its application to non-contract situations. However, if there is no contract between the members there would be nothing to bind the appointed enforcer to his duties and obligations, and so, in practice this solution might prove to be wholly unworkable.
